1. Agreement to Terms
By accessing or using OrderKit (available at orderkit.ca and associated restaurant subdomains), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform.
These terms govern your use of OrderKit as a customer placing orders through restaurant ordering pages. Restaurant owners and staff are also subject to these terms where applicable. Subscription billing, fees, and other commercial terms for restaurant accounts are set out in a separate merchant agreement.
2. Eligibility
You must have the legal capacity to enter into a binding contract in your province or territory to place an order or create a customer account through OrderKit. By using the platform, you represent that you meet this requirement.
If you are under the age of majority in your province or territory, you confirm that you have permission from a parent or legal guardian to use the platform and place orders.
3. Description of Service
OrderKit provides a white-label online ordering platform for independent restaurants. Restaurants use OrderKit to accept and manage orders from their customers. Customers use restaurant-specific ordering pages to browse menus, place orders, and track order status.
4. Orders and Payments
Orders placed through OrderKit are agreements between you and the individual restaurant, not with OrderKit. OrderKit facilitates the ordering process but is not party to the transaction between you and the restaurant.
Payment terms, cancellation policies, and fulfilment responsibilities are set by each restaurant. Current checkout supports pay-in-store at pickup. Online payment options may be offered in the future.
5. Rewards Program
Restaurants may offer a loyalty rewards program through OrderKit. Points are earned and redeemed according to each restaurant's programme settings. Points have no cash value and may be adjusted or discontinued by the restaurant at any time.
Rewards balances are maintained separately for each restaurant. Points earned at one restaurant cannot be transferred to or redeemed at another.
6. User Accounts
When you create a customer account on any restaurant's OrderKit ordering page, you receive one OrderKit login (email and password) that can be used to sign in on any OrderKit restaurant ordering page.
Each restaurant keeps its own customer record for you. Order history, rewards points, saved addresses, and related preferences are specific to that restaurant and are not shared across restaurants unless we describe otherwise in writing.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@orderkit.ca if you suspect unauthorised access.
7. Acceptable Use
You agree not to:
- Place fraudulent or bad-faith orders
- Attempt to circumvent pricing, promotions, or rewards mechanisms
- Interfere with the platform's operation or security
- Use the platform for any unlawful purpose
8. Intellectual Property
The OrderKit platform, branding, and software are owned by Elora & Co. Restaurant content (menus, logos, images) remains the property of each respective restaurant.
9. Limitation of Liability
OrderKit is provided "as is." To the maximum extent permitted by law, OrderKit and its operators are not liable for any indirect, incidental, or consequential damages arising from your use of the platform, including missed orders, failed payments, or data loss.
10. Governing Law
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that any dispute arising from these terms or your use of the platform as a customer will be brought exclusively in the courts located in British Columbia, Canada.
11. Modifications
We may update these terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated terms.
